Drunk Tank Giveaway - Offical Rules

NO PURCHASE NECESSARY TO ENTER OR TO WIN. ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED BY LAW OR ORGANIZATIONAL POLICY.

2. Eligibility: Contest open only to residents of North America 18 years or older at the time of entry. Contest is not open to employees of McCarty PhotoWorks, Achy Breaky Toys, or their divisions and advertising or promotional agencies, or the immediate family members of such employees.

3. Entry: The Drunk Tank Giveaway will begin at 10 p.m PST on January 21st, 2004 and will end at 5 p.m PST on February 22nd, 2004.

4. Prizes and Odds: Two Grand Prize Winners will be selected in a random drawing from among all eligible entries to be held on or about February 23rd, 2004. Winner from emailed entries will receive a signed 12 3/4” x 17” print of “A Night in the Drunk Tank” (#2/20). Winner from entries received at the New York International Toy Fair will receive a framed (with corrugated metal siding and Plexiglas) and signed print of “A Night in the Drunk Tank” (#1/20). Odds of winning depend on the number of eligible entries received.

5. Winner Notification and Acceptance: Winner will be notified by electronic mail on or about February 25th, 2004. Return of prize notification as undeliverable may result in disqualification and an alternate winner may be selected. Winner may waive his/her right to receive the prize. Prize is non-assignable and nontransferable. No substitutions allowed, except that the prize and individual components of the prize are subject to availability, and McCarty PhotoWorks reserves the right to substitute a prize of equal or greater value. Winner is solely responsible for reporting and payment of any taxes on prize. Winner may be required to complete an affidavit of eligibility, which must be returned within ten days of date of postmark. Failure to sign and return the affidavit within ten days, or to comply with any term or condition of these Official Rules, may, at the discretion of McCarty PhotoWorks, result in winner's disqualification, the forfeiture of his/her prize, and the award of prize to an alternate winner. Except where prohibited, participation in the contest constitutes entrant's consent to the publication of his/her name in any media for any commercial or promotional purpose, without limitation or further compensation.

6. Participation: By participating, entrants agree to be bound by these Official Contest Rules and the decisions of the judges. Entrants agree to subscribe to electronic and mail marketing lists for McCarty PhotoWorks and Achy Breaky Toys. Information will not be shared or sold to any outside parties. Subscriptions may be cancelled at any time.

7. Limitations of Liability: By entering the Contest, entrant agrees that (1) any and all disputes, claims and causes of action arising out of or in connection with the Contest, or the prize awarded, shall be resolved individually without resort to any form of class action; (2) any claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Contest, but in no event attorney's fees; and (3) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim, punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages, other than damages for actual out-of-pocket expenses.

8. Construction: All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Contest Rules, or the rights and obligations of any contestant and McCarty PhotoWorks, shall be governed by, and construed in accordance with the laws of the state of California, without giving effect to any choice of law or conflict of law rules or provisions (whether of California, or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than California.

9. General Release: By entering the Contest, contestants release McCarty PhotoWorks and each of their affiliated companies, directors, officers, employees, representatives, partners and agents from any liability whatsoever for any claims, costs, injuries, losses or damages of any kind arising out of or in connection with the Contest or with the acceptance, possession or use of the prize (including, without limitation, claims, costs, injuries, losses or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light).

10. The Drunk Tank Giveaway is sponsored by McCarty PhotoWorks and Achy Breaky Toys, whose decisions regarding the selection of the winner and all other aspects of the Contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Contest Rules or in any other materials relating to the Contest.
